Certain EADs Extended Through April 2, 2026, Pending Further Litigation

On March 31, 2025, the United States District Court for the Northern District of California ordered a postponement of the vacatur (published February 3, 2025) and the termination (published February 5, 2025) of the 2023 Temporary Protected Status (TPS) designation for Venezuela.

As a result of the District Court’s order, TPS for Venezuela will remain in effect until the Department of Homeland Security (DHS) obtains relief from that order. Additionally, Employment Authorization Documents (EADs) with the following expiration dates are automatically extended through April 2, 2026, pending further litigation. The following extensions apply to EADs issued under the Venezuela TPS designations:

• September 10, 2025

• April 2, 2025

• March 10, 2024

• September 9, 2022

Employers should regularly refer to the TPS webpage for updates.

Employer Compliance and Form I-9 Completion

When completing or updating Form I-9, Employment Eligibility Verification, for TPS Venezuela beneficiaries presenting an EAD with a Category Code of A12 or C19 and one of the listed expiration dates above, employers should enter April 2, 2026, pending further litigation, as the new expiration date of the automatically extended EAD. Employers must reverify these employees before they begin work on April 3, 2026.
