Update on TPS for Venezuela

Client Alert!

On May 19, 2025, the U.S. Supreme Court, in an 8-1 decision, granted the government’s request to stay a lower court ruling that had blocked the termination of Temporary Protected Status (TPS) under the 2023 designation for Venezuela. This means the district court’s March 31, 2025, order is on hold while the case proceeds before the Ninth Circuit Court of Appeals.

As background, Secretary of Homeland Security Kristi Noem’s decision to vacate the January 17, 2025, notice extending TPS for Venezuela was published on February 3, 2025. The termination notice for the 2023 designation followed on February 5, 2025.

Please note: TPS under the 2021 designation for Venezuela remains in effect through September 10, 2025.
